Separation in a Divorce
A married couple must be separated before filing for a divorce in Georgia. Under our state’s laws, this simply means that the couple must no longer be sharing a bedroom or having marital relations.
The law intends for the separation to be a period during which the spouses can pause and decide whether or not to proceed with a divorce. Because divorce is a costly and often lengthy process, it is important to take this time to be sure that proceeding is really what you want to do.
Separation and Timing
It is important to note that there is no time limit on the length of the separation before divorce papers can be filed in Georgia. The date of separation must simply be prior to the date the divorce is requested.
